# Privacy Policy

**Company:** Nebula Nova Inc., a Delaware corporation ("Nebula Nova," "we," "us," or "our").\
**Effective date:** October 18, 2025.

Nebula Nova cares about your privacy. This Privacy Policy (the **"Policy"**) describes how we collect, use, disclose, and protect **Personal Information** in connection with our public website at **meganova.ai**, our applications, dashboards, APIs, and any other online or offline services that reference this Policy (collectively, the **"Services"**).

> **Scope.** This Policy covers the Services listed above. Your use of the **public Site** is also governed by our [**Terms of Service**](/legal-docs/terms-of-service.md). If you access restricted areas or any product that requires a login (free or paid modules, referral/provider programs, or APIs), your use is additionally governed by the **Service Terms** you accept at signup.

## 1) Key Definitions

**Personal Information** means information that identifies, relates to, describes, or can reasonably be linked to an identified or identifiable individual. Personal Information does **not** include aggregated, de‑identified, or anonymized information that cannot reasonably be linked to you.

**You** means any individual who uses or interacts with the Services. Employees and job applicants should refer to our **People Data Notice** for HR data processing.

## 2) Information We Collect

We collect Personal Information in the following ways:

**A. Information you provide directly.**

* Contact details (name, email, phone, address), account credentials, support requests.
* Identity/verification data (e.g., date of birth; government‑issued ID if required for compliance or fraud prevention).
* Professional details (company, role, team) and billing data (wallet address, payment method) when you purchase paid Services.
* Content you upload or generate when using the Services (e.g., prompts, files, messages, model preferences, and usage settings).

**B. Information collected automatically.**

* Usage data and logs (e.g., pages viewed, features used, request/response timestamps, concurrency, tokens and model identifiers, error codes, and diagnostics).

**C. Information from other sources.**

* Third‑party sign‑ins or integrations (e.g., GitHub, Google). We receive data authorized in your third‑party settings (e.g., name, email). You can disconnect at any time.
* Partners, service providers, resellers, or your organization (if you use Services under an enterprise account).
* Publicly available sources, and (with your permission) signals like precise geolocation or contacts if a feature explicitly requests them.

**D. Social and community features.**

* Profiles, posts, or messages you choose to share in community spaces (forums, chat, or model galleries) may be visible to others.

## 3) How We Use Personal Information

The specific uses depend on your relationship with us, but generally we use Personal Information to:

* **Provide and maintain** the Services, including account creation, authentication, and customer support.
* **Process transactions** and manage billing, fraud screening, chargebacks, and tax/reconciliation.
* **Operate and secure** the platform, including rate‑limit enforcement, abuse and spam detection, incident response, and to protect the rights, property, or safety of our users and the public.
* **Improve, research, and develop** the Services, including analytics, quality assurance, safety systems, testing, anonymization/aggregation, and developing new features.
* **Personalize and communicate,** including sending service notices and, where permitted by law, marketing communications (you may opt out at any time).
* **Comply with law** and enforce agreements, including responding to lawful requests and resolving disputes.

> **Free/Trial Modules.** Free or promotional modules are meant for **evaluation and interactive** use, not production or unattended batch workloads. We monitor for disruptive patterns and may take action (including suspension) under the applicable Service Terms. ## 4) How We Share Personal Information

We share Personal Information in limited circumstances:

* **Within Nebula Nova and affiliates** for the purposes described in this Policy.
* **Service providers/processors** that host, support, analyze, or secure the Services under appropriate agreements.
* **Community visibility** where you choose to publish profiles, posts, or content to forums, galleries, or directories.
* **Legal, safety, and compliance,** including responding to lawful requests, preventing fraud/abuse, and protecting our rights and users.
* **Business transfers** (e.g., merger, acquisition, financing, or asset sale), where your information may be transferred as part of the transaction.
* **Advertising/analytics partners** via cookies or SDKs in accordance with your preferences and our [**Cookie Policy**](/legal-docs/cookie-policy.md).
* **With your consent** or at your direction (e.g., integrations you enable, or research/surveys you choose to join).

We do **not** sell Personal Information for money. Where the law treats certain advertising/analytics disclosures as a "sale" or "sharing for cross‑context behavioral advertising," you can opt out via the controls described in the **Cookie Policy** and, where applicable, a **“Do Not Sell or Share My Personal Information”** link.

## 5) Your Rights & Choices

Depending on your jurisdiction, you may have rights to **access**, **correct**, **delete**, **restrict** or **object** to certain processing, and to **data portability**. We will verify your request consistent with applicable law.

* **Marketing choices.** You can opt out of marketing emails via the unsubscribe link. We will still send transactional or service‑related messages.
* **Cookies/ads.** Manage preferences through our **Cookie Policy** controls and your browser settings. Industry tools: **DAA/AdChoices**, **NAI**, and **EDAA** (where available).

## 6) International Transfers

We are based in the **United States**. If you access the Services from outside the U.S., your information may be transferred to and processed in the U.S. and other countries that may have different data protection laws. Where required, we use appropriate safeguards (e.g., **Standard Contractual Clauses** and supplementary measures) for cross‑border transfers.

## 7) Retention

We retain Personal Information for as long as necessary to provide the Services and for other legitimate purposes, including to:

* maintain business and financial records;
* comply with legal obligations;
* resolve disputes and enforce agreements; and
* support safety, security, auditing, and product improvement.

> **Roadmap:** We are evaluating **quantum‑safe cryptography** for certain control‑plane communications and exploring **quantum‑inspired scheduling** to enhance fair‑use enforcement and throughput under bursty workloads. These initiatives may evolve and are not a commitment.

## 9) Children’s Privacy

Our Services are **not directed to children under 16**. We do not knowingly collect Personal Information from children under 16. If you believe we have collected such information, contact us and we will delete it.

## 10) Automated Decision‑Making

We do not currently make solely automated decisions that produce legal or similarly significant effects about you. If we introduce such features, we will implement required safeguards (e.g., the ability to request human review) where applicable by law.

## 11) Social Media, Public Forums, and Links

Content you post in public forums or on social media may be visible to others. We are not responsible for third‑party sites or their privacy practices. Review their policies before sharing information.

## 12) Changes to this Policy

We may update this Policy from time to time. The **Effective date** above reflects the latest version. Material changes will be posted to the Services (and, where required by law, we will provide additional notice). Your continued use of the Services after the Effective date means you accept the updated Policy.

## 13) Region‑Specific Disclosures

* **EEA/UK/Switzerland.** You have the rights described in Section 5 and may lodge a complaint with your local supervisory authority. When we rely on consent, you may withdraw it at any time.
* **California (CPRA).** California residents can exercise rights of access, deletion, correction, and to opt out of certain disclosures that may be considered "selling" or "sharing" of personal information for cross‑context behavioral advertising. Authorized agents may submit requests per state law.
* **Canada (PIPEDA/Provincial).** You have rights of access and correction subject to lawful exceptions. Contact us to exercise your rights.
